Third Party Capture?
If you have been injured in a road traffic accident that wasn’t your fault, you could be missing out on full compensation.
Pickworths have covered this subject before but Third Party Capture worryingly appears to be on the increase with some insurance companies of negligent drivers all too quick to offer you money.
You of course expect to receive compensation from the negligent driver’s insurance company. In the past some companies have not made this process easy. Now some are willing to call you and offer damages within weeks of the incident occurring. They just ask you to provide details. They will sometimes arrange a medical report (more usually with a GP rather than a consultant) and make an offer. It has cost you nothing and you will receive compensation fairly quickly - How can you refuse?
This is third party capture. You are the third party and you have been caught!
Damages offered this way are usually very low. If you had instructed your own solicitor the figure in our experience could be double or treble but certainly more than you would otherwise be offered.
Some injuries can get progressively worse after an accident and in severe cases be life debilitating. If you have accepted a small amount of compensation within weeks it won’t compensate your loss, particularly if you need time off work or are not able to work at all in the future. Your own solicitor can instruct a specialist consultant to provide a detailed report, who is experienced in dealing with specific injuries and knows the long term consequences of those injuries.
How can you help yourself?
Do not accept an offer until you have spoken to an Independent specialist lawyer not associated with the insurance company concerned.
